Will my client get their AMT back?

Only in a year when regular federal tax is higher than AMT. The amount recovered is the lesser of that gap and the carryforward left. If the same income profile repeats, the gap never opens and the AMT can expire unused.

Carryforward7 years

No carryback. Then it expires.

Flat federal rate since 2024.

2026 exemption$181,440

Below this, no AMT arises.

Since the 2024 reforms, AMT reaches ordinary investors, and for many it comes back the next year instead of reversing. Below: how recovery is calculated, who gets caught, and where practice goes wrong.

This guide covers how recovery works. The strategies themselves, worked through with numbers, are in AMT Recovery Mission, taught by Michael Cadesky and Hugh Woolley.

01The short answer

How AMT recovery works

AMT paid in one year is not lost straight away. It becomes a carryforward that can be applied against regular tax in later years, but only in years where regular tax is higher than AMT.

The rule

Recovery in a year = the lesser of (A) regular federal tax minus AMT for that year, and (B) the AMT carryforward still remaining.

Seven years, no carryback

The carryforward lasts seven years. There is no carryback. Anything not recovered by the end of year seven expires and becomes a permanent tax cost.

Provincial AMT follows the federal amount

Provincial AMT is recovered alongside the federal amount, but generally only against that province’s tax. Quebec runs its own separate system.

02The formula in practice

Why “it comes back next year” is often wrong

The formula only produces a recovery when there is a gap between regular tax and AMT. If AMT is equal to or higher than regular tax, part (A) is nil and nothing comes back, no matter how large the carryforward is.

Step 1Regular tax

Compute regular federal tax for the year as normal.

Step 2Minus AMT

Compute AMT for the same year. The difference is the recovery room.

Step 3Lesser of

Recover the smaller of that room and the carryforward left.

That is why recovery stalls. Clients were told their AMT would come back the following year. For many it didn’t, because the same income profile that triggered AMT once triggered it again, and the recovery room never opened.

03What changed in 2024

Why AMT now recurs instead of reversing

The 2024 reforms gave AMT a much broader base: more income is included and fewer deductions are allowed, so AMT taxable income can run well above regular taxable income. At the same time the federal rate rose to 20.5% and many personal credits are only 50% allowed.

The effect on investors is a stealth increase on capital gains. A 20.5% flat AMT rate sits 4 points above the 16.5% top federal rate on a capital gain, and once provincial AMT is added the extra cost is roughly 5 to 6 points on the gain.

Item Regular tax AMT
Capital gains inclusion 50% 100%
Gains sheltered by the capital gains exemption Nil 30% included
Net capital losses carried over Deductible Effectively 50%
Interest expense and investment counsel fees Deductible 50%
Taxable dividends Grossed up, with dividend tax credit Actual amount, no credit
Tax shelter deductions Deductible Nil
Personal credits Full 50%
Federal rate Up to 33% 20.5% flat
Exemption (2026) N/A $181,440

04Who gets caught

The four profiles that cause AMT

AMT mostly targets individuals and trusts with substantial investments. In practice it shows up in four clusters, alone or in combination:

Large gains and investment costs

A large capital gain, a net capital loss claim, interest expense and investment counsel fees. Worst when they land together.

Tax shelters with borrowing

Shelter deductions financed with deductible interest, the long-standing route into AMT.

Large stock option deductions

A big exercise and sale can produce AMT on its own once it is large relative to other income.

Large donations of public stock

Rarely enough alone, but they aggravate AMT when combined with the other clusters.

One-off event or built-in profile?

The first question for any client with a carryforward is whether AMT was a one-off event or built into their profile. A one-off can often be recovered by managing the following years. A recurring profile has to be changed first, or recovery never starts.

05Why recovery stalls

Recovering AMT is a planning problem, not a waiting game

A successful recovery plan has to do three things at once:

  • Bring the current year’s AMT below regular federal tax.
  • Do it without unduly raising regular federal tax, since paying more regular tax to recover AMT is no win.
  • Avoid timing differences that simply push AMT into the next year.

That narrow overlap between regular tax planning and AMT planning is where every useful strategy sits. The levers practitioners use are covered in AMT recovery strategies.

The special situations

Some events change the picture entirely. AMT does not apply in the year of death, so a carryforward can be applied in full against regular tax on the final return. A move to another province can strand provincial AMT. Trusts and expiring carryforwards each need their own analysis.

How each of these is modelled, and where it fails, is worked through in AMT Recovery Mission.

06Where practice goes wrong

Six common AMT recovery mistakes

These come up repeatedly with clients carrying forward AMT. Most cost recovery room; some let the carryforward expire outright.

1

Assuming recovery is automatic next year

Recovery only happens when regular tax exceeds AMT. If the same profile repeats, nothing comes back.

2

Not asking why AMT arose

Treating a built-in profile like a one-off. If the cause recurs every year, the profile has to change before recovery can start.

3

Raising regular tax just to recover AMT

Opening the recovery gap by paying more regular tax than necessary is no win for the client.

4

Creating timing differences

Moves that only shift income or deductions between years can push AMT into the next year instead of resolving it.

5

Losing track of the seven-year clock

Unrecovered amounts expire after year seven, with no carryback. Oldest amounts need attention first.

6

Overlooking provincial AMT on a move

Provincial AMT is generally recoverable only against that province’s tax. A move can strand it.

07Before you plan

Pre-planning checklist

For any client with an AMT carryforward, confirm the following. For a quicker yes/no read on a single client, use the 3-minute recovery checklist.

  • List the carryforward by year. Note which amounts are closest to the seven-year limit.

  • Identify the cause. Gains and investment costs, shelters, stock options, donations, or a combination.

  • Decide if it was one-off or recurring. Recurring profiles need changing before recovery can begin.

  • Project regular tax and AMT for the coming year. Recovery room only exists where regular tax is higher.

  • Test each planning move against both systems. It should not unduly raise regular tax or create a timing difference.

  • Flag special situations. Planned moves between provinces, trusts, and estate planning where the year of death may matter.

08FAQ

AMT recovery questions

How is AMT recovered in Canada?

AMT paid in a year becomes a carryforward that can be used for seven years. In each later year, the amount recovered is the lesser of regular federal tax minus AMT for that year, and the carryforward remaining. Provincial AMT is recovered alongside the federal amount.

Why didn’t my client recover AMT the year after paying it?

Recovery only happens in a year when regular tax is higher than AMT. If the same items that caused AMT appear again, such as capital gains, loss claims, interest expense or investment counsel fees, AMT stays at or above regular tax and nothing is recovered.

How long does an AMT carryforward last?

Seven years, with no carryback. Any amount not recovered by the end of the seventh year expires and becomes a permanent tax cost.

What is the AMT exemption for 2026?

$181,440. If AMT taxable income is below the exemption, no AMT arises for the year.

Is there AMT in the year of death?

No. AMT does not apply in the year of death, so an AMT carryforward can be applied in full against the regular tax on the final return, up to the regular tax otherwise payable.

Can provincial AMT be lost?

Yes. Provincial AMT is generally recoverable only against that province’s tax, so a carryforward can be lost if the individual moves to another province. Quebec operates its own separate system.

What this guide doesn’t answer

You know why the AMT is stuck. The next questions are harder.

  1. Which of about a dozen recovery strategies fits this client, and what does it do to the numbers?
  2. When does a strategy that looks right just push AMT into next year?
  3. How do you combine approaches without raising regular tax?
  4. What changes on death, on leaving the province, inside a trust, or with a carryforward about to expire?

Each of these is worked through with full numbers in AMT Recovery Mission. On demand, 1.5h verifiable CPD, $75.
